As a workplace activity, whilst on placement or during paid employment in the relevant industry, identify three (3) situations that you observed, that have legal and/or ethical considerations, and complete the questions and activity to demonstrate the underpinning knowledge and skills required to appropriately respond in each situation.

As a simulated activity, watch three (3) role played recordings through the links provided and read the corresponding scenarios and identify the legal and/or ethical considerations.

You should observe the scenario as if you had just walked in on the situation, so you are a third-party person observing the incident.

These may relate to best practice, non-compliance or questionable work practices. Complete the questions and activity to demonstrate the underpinning knowledge and skills required to appropriately respond in each situation.

Situation 1
  1. Identify and describe in detail the legal and / or ethical situation you have either observed during your placement, or watched and read in the provided link / scenario.
  2. I witnessed an interaction of 2 support workers with a participant being introduced to one another for the first time. However in this interaction the participant had given one of the Support workers 50 instant scratches to take home with her to do herself. Participant was even quoted saying

    I've saved up all my pension to get you these. In which the Support worker (Ronnie) accepted the gift in which Sarah offered her.

  3. List relevant pieces of legislation and/or organisational guidelines that you would need knowledge of and may need to access, in order to respond to this situation. Provide a minimum of two (2) pieces of each
  4. Having an understanding of Duty of care in this situation as Sarah has memory loss problems and its our duty of care to make sure she is not been taken advantage of.

  5. In your role of a support worker and following organisation policy and procedure, how would respond in this situation?

I would watch the interaction pan out and then politely take Ronnie away and discuss with her the impact this may have on Sarah wellbeing and financial state as she even mentioned she forgets things and might not remember purchasing them for you. Also discussing with Ronnie how its not ethically right to take those sorts of gifts from participants.

    I would then discuss the matter with my Manager to let her know of the situation that had taken place so she is aware of it. Also writing it in my notes for record.

  7. Provide two (2) strategies that you could discuss with your manager that could be used to increase staff knowledge and awareness of how to respond if this scenario occurs again to ensure best practices are followed?

Asking to call staff meetings more regular and discuss the option of staff explaining things that might of happened throughout the week that we can discuss as a group and how we can go doing things better the next time a similar situation arises. This way it gives employees time to think and reflect on their own actions and how they would approach it differently.

  10. Support worker had entered the room with SW Ronnie, SW Virginia, Miss Sarah and Myself. SW Ronnie wanted to introduce Virginia to Sarah. Ronnie pulled up a chair to sit next to Sarah and Virginia also followed. Sarah reached out and placed her hand on Ronnies legs and Ronnie had placed her hand around Sarahs arm. The 2 conversed about the upcoming week and how Virginia would take over. Sarah was concerned about having a new SW on board but Ronnie was able to calm her nerves. At the end of the conversation Sarah had pulled out 50 instant scratchies to give to Ronnie as a send off gift, SW even heard Sarah say that she had saved her entire pension to gift Ronnie this. Ronnie did accept Sarahs gift and thanked her for it. All SW left.
